1. Who you are contracting with

These Terms & Conditions ("Terms") govern your use of the Daily Affirmations website and services (the "Service"), which is operated by Chris Sheridan ("we", "us", "our"). By using the Service, you are entering into an agreement with Chris Sheridan.

2. Acceptance of these Terms

By accessing or continuing to use the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service. You confirm that you are of legal age to form a binding contract.

3. The Service

Daily Affirmations lets you view daily affirmations, publish affirmations to a community wall, and send personalised affirmations to others. Some features, such as sending an affirmation to a friend, require a payment.

4. Acceptable use

You agree not to misuse the Service. In particular, you must not:

• use the Service for any unlawful, fraudulent, or harmful purpose;
• send spam, harassment, hateful, or abusive content;
• infringe the intellectual property or other rights of others;
• interfere with or compromise the security of the Service, including by introducing malware, probing, or scraping;
• attempt to reverse engineer, resell, or redistribute the Service.

You are responsible for the content you submit, including affirmations you publish or send, and you must have the right to share that content.

5. Intellectual property

We retain all ownership of the Service and its intellectual property, including the software, design, and branding. You are granted a limited, non-exclusive, non-transferable right to use the Service for its intended purpose.

6. Payments and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Please also see our Refund Policy.

7. Service availability

We aim to keep the Service available and reliable, but we do not guarantee that it will be uninterrupted or error-free. The Service is provided on an "as is" and "as available" basis, and we disclaim all implied warranties to the fullest extent permitted by law.

8. Suspension and termination

We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay amounts due, create a security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the Service at any time.

9. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law.

10. Governing law

These Terms are governed by the laws of the jurisdiction in which Chris Sheridan operates, and disputes will be subject to the courts of that jurisdiction, unless applicable law requires otherwise.

11. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page and revise the "last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
